James Boasberg, a US District Judge in DC appointed by Barack Obama, insists he was ‘randomly’ assigned to the Alien Enemies Act case related to deported Venezuelan gang members.
However, it appears Boasberg purposely inserted himself in the case.
Last month, Judge Boasberg granted a temporary restraining order (TRO) to stop the Trump administration from deporting thousands of Venezuelan nationals under the Alien Enemies Act.
Far-left America-hating leftist groups, such as the ACLU and Democracy Forward, rushed to a DC court in a desperate bid to shield dangerous illegal aliens from deportation.
The lawsuit was filed just after midnight and in the the early hours of Saturday, March 15 and surprise, surprise, Boasberg grabbed the case a few hours later that morning even though he was on vacation.
Senator Eric Schmitt (R-MO) said Boasberg wasn’t even the emergency assignment judge on March 15, so he likely used his position as Chief Judge to insert himself into the case.
“How did Judge Boasberg get the TdA case when he wasn’t the emergency assignment judge on March 15? Did he use his position as Chief Judge to force himself onto the case? The American people are demanding answers. I’ll be filing legislation to require random case assignments,” Senator Schmitt said.
“Judge Boasberg over the weekend it came out – he’s not the emergency judge in DC. He inserted himself in that role. He was on vacation. The case was filed at 2:30 in the morning. Somehow he ended up with that case. He wasn’t the emergency judge on duty so I think this requires further investigation and legislation,” Schmitt said.
Schmitt continued, “He is the chief judge and he inserted himself. That doesn’t happen. The emergency judges 100% of the time get those cases. So he could have been tipped off that this was going to be filed and while on vacation he took the case.”
