A federal judge in Minnesota has issued a restraining order blocking the Department of Homeland Security (DHS) from handling evidence in an ongoing investigation into an attack on federal agents.
The order comes amidst a firestorm of attacks from radical leftist politicians, including Minnesota Governor Tim Walz and Attorney General Keith Ellison, who have launched a coordinated campaign against the Trump Administration’s efforts to restore law and order in the Twin Cities.
On Saturday, U.S. District Court Judge Eric Tostrud, a Trump appointee, granted a temporary restraining order against the DHS and FBI to “immediately stop destroying, altering, or tampering with any evidence” connected to the deadly incident, including the shooting of a suspect identified as Alex Jeffrey Pretti.
It can be recalled that Pretti approached Border Patrol officers while carrying a 9mm semiautomatic handgun and began forcefully resisting orders.
The lawsuit was filed by the Minnesota Bureau of Criminal Apprehension (BCA) and the Hennepin County Attorney’s Office, led by Attorney General Keith Ellison, who alleges that federal authorities removed evidence from the scene and took exclusive custody of key materials related to the shooting.
According to the court order, state officials were compelled to seek immediate judicial intervention to prevent the potential destruction or alteration of evidence by federal agencies involved in the shooting.
After reviewing the complaint and supporting filings, Judge Tostrud granted the TRO, explicitly barring federal officials and anyone acting on their behalf from destroying or altering evidence connected to the fatal shooting, including evidence already removed from the scene or placed under federal control.
The court also waived the bond requirement.
The judge has scheduled a court hearing on Monday at 2:00 p.m. in St. Paul, where federal defendants will have an opportunity to object and argue whether the restraining order should remain in place.
Judge Tostrud has also given the Trump administration until midday Monday to respond to the order.
