Newly inaugurated Democratic Gov. Abigail Spanberger signed legislation sending a radical congressional redistricting referendum to Virginia voters that would upend the commonwealth’s electoral landscape and hand Democrats a 10-1 advantage in the U.S. House delegation, expanding a 6D–5R delegation into a potential 10 Democrats, 1 Republican dominance.
Last month, Tazewell County Circuit Court Judge Jack Hurley Jr. issued a blistering ruling that effectively dismantles the Democrats’ partisan redistricting scheme, declaring their process unconstitutional and blocking any referendum on the matter until after the 2027 House of Delegates election.
The controversy centers on a brazen 11th-hour maneuver by Democrats in Richmond to bypass Virginia’s voter-approved Bipartisan Redistricting Commission.
Fearful of losing their grip on power in Washington, Democrat leadership attempted to ram through a constitutional amendment that would have handed map-drawing power back to the legislature, allowing them to gerrymander a permanent advantage in the state’s congressional delegation ahead of the crucial 2026 midterms.
In his decision, Judge Hurley found that Democrats had trampled over the state’s constitutional requirements in their haste to seize power.
The court ruled that the legislature failed to provide the mandatory 90-day public notice before voting on the amendment, a basic transparency measure designed to keep the public informed.
Even more egregious was the timing. Democrats attempted to pass the amendment during the 2025 special session while early voting for the November election was already underway.
On Friday morning, Gov. Spanberger used her executive pen to sign a bill that officially sets an April 21 referendum.
Spanberger publicly stated she won’t block the Democratic plan and will allow the referendum to proceed.
If approved by voters, the measure would authorize the General Assembly to redraw the state’s congressional districts mid-decade, replacing the current court-drawn map.
Current Map: The state’s 11 districts are currently split 6 Democrats to 5 Republicans.
Proposed Map: The new lines are projected to create a 10 Democrat to 1 Republican advantage.
Impact: Political analysts indicate the map would make the 9th District (Southwest Virginia) the sole safe Republican seat, while endangering several Republican incumbents by shifting their districts significantly.
