A federal judge has blocked President Donald Trump’s deployment of National Guard troops in Los Angeles.
U.S. District Judge Charles Breyer declared the deployment illegal and ordered the troops returned to state control under California Governor Gavin Newsom.
The decision stems from Trump’s deployment of thousands of National Guard troops to Los Angeles this summer amid violent protests and riots tied to immigration enforcement.
While most troops were withdrawn, an extension kept approximately 300 California National Guard members under federal control until February, with about 100 remaining in the city and 200 redirected to Oregon.
California officials, including Newsom and Attorney General Rob Bonta, filed a lawsuit challenging the federalization of state troops.
Breyer sided with the state in his 35-page opinion, arguing that Trump lacked the statutory authority under laws that allow such deployments only in cases of invasion, rebellion, or when the president cannot execute federal laws with regular forces.
The judge emphasized that there was no current demonstration of impaired law enforcement, stating, “The Founders designed our government to be a system of checks and balances. Defendants, however, make clear that the only check they want is a blank one.”
Breyer added, “Without a demonstration that the President’s ability to execute the law is currently being impeded at the time of deployment, he lacks adequate grounds for federalization.”
The judge has paused his ruling until Monday to give the Justice Department time to appeal, potentially escalating the case to higher courts.
The White House fired back, defending the president’s actions.
“President Trump exercised his lawful authority to deploy National Guard troops to support federal officers and assets following violent riots that local leaders like Newscum refused to stop,” White House spokeswoman Abigail Jackson said in a statement obtained by The Hill.
The White House added, “We look forward to ultimate victory on the issue.”
